Ladies and Gentlemen! Welcome to the Seoul Motor Show.
We guess you know that Korean automobile makers, including Hyundai-Kia which faces the global top 6, have grown considerably in the world market such as North America, Europe and China. But, do you know the fact that many non-regular workers who are employee of internal subcontract factories are working under all kinds of sorrow and discrimination? And do you know that they are not guaranteed the fundamental rights provided by ILO as well as human rights which is the universal value?

Let me tell you our surprising experience. In 2003, a worker at A-san internal  subcontract factory of Hyundai motor applied a monthly leave which is guaranteed by the law. But he was rejected and even taken to hospital because of violence by his manager. That's not all. In the hospital, the company manager attacked him and stabbed violently his Achilles tendon two times with a fruit knife.

½ÉÁö¾î 2003³â¿¡´Â Çö´ëÀÚµ¿Â÷ ¾Æ»ê°øÀå¿¡¼­ ÀÏÇÏ´Â ÇÏû³ëµ¿ÀÚ°¡ ±Ù·Î±âÁعýÀÌ º¸ÀåÇÏ´Â ¿ùÂ÷ÈÞ°¡¸¦ »ç¿ëÇÏ°Ú´Ù´Â °ÍÀÌ ¹ß´ÜÀÌ µÇ¾î º´¿ø¿¡ ´©¿ö ÀÖ´Â »óȲ¿¡¼­ ȸ»ç °ü¸®ÀÚ¿¡°Ô ¾Æų·¹½º°Ç ºÎÀ§¸¦ °úµµ·Î 2Â÷·Ê ³­ÀÚ´çÇÏ´Â Å×·¯±îÁö ´çÇϱ⵵ ÇÏ¿´½À´Ï´Ù.


To overcome such coares condition, non-regular workers established the trade union. We non-regular workers are struggling here and there. At the Hyundai motors factories placed at Ul-san, Cjeon-ju and A-san, at the Hyundai Heavy Industries, at the Cheong-ju factory of Hynix Semiconductor, at the Chang-won factory of GM-Daewoo, and at the Hwa-seong factory of Kia motors.

ÀÌ·± ¿­¾ÇÇÑ Çö½ÇÀ» ±Øº¹Çϱâ À§ÇØ ºñÁ¤±ÔÁ÷ ³ëµ¿ÀÚµéÀº ½º½º·Î ³ëµ¿Á¶ÇÕÀ» ¼³¸³ÇÏ¿´½À´Ï´Ù. Çö´ëÀÚµ¿Â÷ÀÇ ¿ï»ê¡¤ÀüÁÖ¡¤¾Æ»ê°øÀå¿¡¼­, Çö´ëÁß°ø¾÷¿¡¼­, ÇÏÀ̴нº¹ÝµµÃ¼ ûÁÖ°øÀå¿¡¼­, GM´ë¿ìÀÚµ¿Â÷ â¿ø°øÀå¿¡¼­, ±â¾ÆÀÚµ¿Â÷ È­¼º°øÀå¿¡¼­ ¿ì¸® ºñÁ¤±ÔÁ÷ ³ëµ¿ÀÚµéÀÌ ÅõÀïÇÏ°í ÀÖ½À´Ï´Ù.


But Hyundai Motors, Hyundai Heavy Indutsries, Hynix Semiconductor, GM-Daewoo and Kia Motors which are contractors have oppressed with discharge, complaint and indictment, provisional disposition and attachment, illegal investigation, illegal commitment of substitute workforce and so on. They did it by themselves or made subcontractors do.

ÇÏÁö¸¸ ¿øûÀÎ Çö´ëÀÚµ¿Â÷, Çö´ëÁß°ø¾÷, ÇÏÀ̴нº¹ÝµµÃ¼, GM´ë¿ìÀÚµ¿Â÷, ±â¾ÆÀÚµ¿Â÷´Â »ç³»ÇÏû¾÷ü¸¦ ÀÌ¿ëÇϰųª Á÷Á¢ ³ª¼­ ºñÁ¤±ÔÁ÷ ³ëµ¿ÀÚµéÀ» ÇØ°í¿Í °í¼Ò°í¹ß, °¡¾Ð·ù¡¤°¡Ã³ºÐ, ºÒ¹ý»çÂû, ºÒ¹ý´ëüÀη ÅõÀÔ µîÀ¸·Î ź¾ÐÇÏ¿´½À´Ï´Ù.


Ministry of Labor decided that Hyundai Motors and GM-Daewoo  did camouflaged contracts and illegal dispatches of workers. According to the supervision regulation of Ministry of Labor, even if companies do so, "Employment Agenda Clause" which means that the workers dispatched for more than 2 years are regarded as employed directly by the contractor must be applied. The clause is contained in Act Relating to Protection ect. for Dispatched Workers. Nevertheless Korean Government doesn't leave a negative attitude on solving the problem, but rather protects the violations of employers.

Çѱ¹Á¤ºÎÀÇ ±¹°¡±â°üÀÎ ³ëµ¿ºÎ¿¡¼­ Çö´ëÀÚµ¿Â÷¿Í GM´ë¿ìÀÚµ¿Â÷¿¡ À§Àåµµ±Þ¿¡ ±âÇÑ ºÒ¹ýÆÄ°ß ÆÇÁ¤À» ³»·È°í, ³ëµ¿ºÎ °ü¸®±ÔÁ¤¿¡ À§Àåµµ±Þ¿¡ ±âÇÑ ºÒ¹ýÆÄ°ß¿¡µµ ÆÄ°ß¹ý¿¡¼­ Á¤ÇÏ´Â ¡°2³âÀÌ»ó ÆÄ°ß±Ù·ÎÀÚ¸¦ °í¿ëÇÏ¸é ¿øûȸ»ç(½Ç»ç¿ëÁÖ)¿¡ Á÷Á¢°í¿ëµÈ °ÍÀ¸·Î °£ÁÖÇÏ´Â °í¿ëÀÇÁ¦ Á¶Çס±À» Àû¿ëÇÑ´Ù´Â ³»ºÎÁöħÀÌ ÀÖÀ½¿¡µµ Çѱ¹Á¤ºÎ´Â ¹®Á¦ÇØ°á¿¡ Àû±Ø ³ª¼­Áö ¾Ê°í ÀÖ½À´Ï´Ù. ¾Æ´Ï ºÒ¹ýÀ» ÇàÇÑ »ç¿ëÁÖ¿¡ ´ëÇØ ºñÈ£ÇÏ°í ÀÖ½À´Ï´Ù.


Hyundai Motors and GM-Daewoo abuse these circumstances to try to make all as lawful non-regular workers and sweat with only low wages and fire on their won authrity instead of employing directly or converting into regular workers.

Çö´ëÀÚµ¿Â÷¿Í GM´ë¿ìÀÚµ¿Â÷´Â ÀÌ °°Àº »óȲÀ» ¾Ç¿ëÇØ Á÷Á¢°í¿ë?Á¤±ÔÁ÷ ÀüȯÀ» Çϱâ´ÂÄ¿³ç ¸ðµÎ ÇÕ¹ýÀû ºñÁ¤±ÔÁ÷À¸·Î ¸¸µé¾î, ÀúÀӱݰú ¸¶À½´ë·Î ÇØ°íÇÒ ¼ö ÀÖµµ·Ï ÇÏ°Ú´Ù°í µÇ·Á Å«¼Ò¸®Ä¡°í ÀÖ½À´Ï´Ù.

Wages and working conditions of non-regular workers in Korea are considerably different from those in your countries. Most of new employment are made up by the non-regular, so workers have no choice and sink to the non-regular. Under such conditions, non-regular workers works in the same as regular workers but take at most 50% of wages of regular ones. Every kind of welfare is more poor. And by reason of doing union activities, despite it is lawful, employers fire workers on their own authorities. In Korea, Social security programs are still so poor that the fired worker and his/her family are threatend their living no sooner than fired.

Çѱ¹ÀÇ ºñÁ¤±ÔÁ÷ ³ëµ¿ÀÚÀÇ ÀÓ±Ý ¹× ±Ù·ÎÁ¶°ÇÀº ´ç½ÅµéÀÇ ³ª¶ó¿Í »ó´çÈ÷ ´Ù¸¨´Ï´Ù. ³ëµ¿ÀÚÀÇ ÀÚ¹ßÀûÀÎ ¼±ÅÃÀÌ ¾Æ´Ï¶ó, ½Å±Ô°í¿ëÀÇ ´ëºÎºÐÀÌ ºñÁ¤±ÔÁ÷ ÇüÅÂÀ̱⿡ ¼±ÅÃÀÇ ¿©Áö¾øÀÌ ºñÁ¤±ÔÁ÷À¸·Î Àü¶ôÇÕ´Ï´Ù. ±×·± »óȲ¿¡¼­ ºñÁ¤±ÔÁ÷À̶ó´Â °í¿ëÇüÅ·Π±Ù·ÎÇÏ¸é °°Àº ÀÏÀ» ÇÏ°íµµ ÀÓ±ÝÀ» Á¤±ÔÁ÷ÀÇ 50% ¹Û¿¡ ¹ÞÁö ¸øÇÕ´Ï´Ù. °¢Á¾ º¹¸®ÈÄ»ýÀÇ Ã³¿ì´Â ´õ¿í ¿­¾ÇÇÕ´Ï´Ù.
¶ÇÇÑ Á¤´çÇÑ ³ëÁ¶È°µ¿À» ÇÑ´Ù°í Çؼ­ »ç¿ëÁÖ ¸¾´ë·Î ÇØ°íÇÒ ¼ö ÀÖµµ·Ï µÇ¾î ÀÖ½À´Ï´Ù. ¾ÆÁ÷ Çѱ¹Àº ½Ç¾÷ÀÚ¿¡ ´ëÇÑ »çȸº¸ÀåÁ¦µµ°¡ Á¦´ë·Î Çü¼ºµÇ¾î ÀÖÁö ¾Ê½À´Ï´Ù. ÇØ°íµÇ¸é ¹Ù·Î ³ëµ¿ÀÚ¿Í ±× °¡Á·ÀÇ »ýÁ¸ÀÌ À§Çù¹Þ°Ô µÇ´Â »óȲÀÎ °ÍÀÔ´Ï´Ù.



Nevertheless Korean Government try to make laws to spread non-regular workers and remove even poor safeguards. The Government bill denies fundamental rules such as freedom of association, prohibition of discrimination, equal-wage for equal-value-work and so on. So, most workers were in opposition to the bill and declared the struggle against the government.

ÀÌ·± »óȲ¿¡¼­µµ Çѱ¹Á¤ºÎ´Â ºñÁ¤±ÔÁ÷À» È®´ëÇÏ°í ÃÖ¼ÒÇÑÀÇ º¸È£µµ ¹«·ÂÈ­½ÃÅ°·Á´Â ¹ý·ü(°á»çÀÇ ÀÚÀ¯ ¿øÄ¢°ú Â÷º°±ÝÁö, µ¿ÀÏ°¡Ä¡³ëµ¿ µ¿ÀÏÀÓ±Ý µîÀÇ ¿øÄ¢µéÀ» ±Ùº»ÀûÀ¸·Î ºÎÁ¤ÇÏ´Â ºñÁ¤±ÔÁ÷ °ü·Ã ¹ý·ü¾È)À» ¸¸µé·Á°í ÇÏ°í ÀÖ½À´Ï´Ù. ÀÌ¿¡ ¸ðµç ³ëµ¿°è°¡ ¹Ý´ëÇÏ°í ÅõÀïÀ» ¼±¾ðÇÏ°í ÀÖ´Â Çö½ÇÀÔ´Ï´Ù.


For example, Korean Confederation of Trade Union (KCTU) sued Korean Government to ILO on the ground that Korean Government was violation against Clause 87, Freedom of Association and Protection of the Right to Organise Convention, and Clause 98, Right to Organise and Collective Bargaining Convention, of ILO Conventions and disturbed rights of workers. "Conclusion of employment relation" adoped at 91th International Labor Conference in 2003 mentioned about "disguised" employment relationships (i.e., workers who are in fact employees but their status is disguised or hidden). This is simillaer to the illegal worker-dispatches spreading in Korea.

ÀÏ·Ê·Î, ¹ÎÁÖ³ëÃÑÀº ¡°Çѱ¹ Á¤ºÎ°¡ ILO 87È£(°á»çÀÇ ÀÚÀ¯ ¹× ´Ü°á±Çº¸È£¿¡ °üÇÑ Çù¾à), 98È£(´Ü°á±Ç ¹× ´Üü±³¼·¿¡ ´ëÇÑ ¿øÄ¢ÀÇ Àû¿ë¿¡ °üÇÑ Çù¾à)À» À§¹ÝÇØ ºñÁ¤±ÔÁ÷ ³ëµ¿ÀÚµéÀÇ ±Ç¸®¸¦ ħÇØÇÏ°í ¹æÄ¡ÇÏ°í ÀÖ´Ù¡±¸ç Çѱ¹Á¤ºÎ¸¦ ±¹Á¦³ëµ¿±â±¸(ILO)¿¡ Á¦¼ÒÇϱ⵵ ÇÏ¿´½À´Ï´Ù.
Áö³­ 2003³â 91Â÷ ILOÃÑȸ¿¡¼­ äÅÃµÈ ¡®°í¿ë°ü°è¿¡ °üÇÑ °á·Ð¹®¡¯¿¡¼­´Â ¡°°í¿ëÇüÅÂÀÇ À§ÀåÀº »ç¿ëÀÚ°¡ Á¾¾÷¿øÀ» Á¾¾÷¿øÀÌ ¾Æ´Ñ °Íó·³ ´ë¿ìÇÔÀ¸·Î½á ³ëµ¿ÀÚÀÇ ÁøÁ¤ÇÑ ¹ýÀû ÁöÀ§¸¦ ÀºÆóÇÑ´Ù (¡¦Áß·«¡¦) ÀÌ´Â ³ëµ¿ÀÚ¿Í »ç¿ëÀÚ ¸ðµÎÀÇ ÀÌÇØ¿¡ ¹ÝÇÏ´Â °ÍÀÌ¸ç °áÄÚ ¿ëÀεż­´Â ¾È µÈ´Ù¡±°í ÁöÀûÇÏ°í Àִµ¥, ÀÌ´Â ÇöÀç Çѱ¹¿¡ ¸¸¿¬µÈ ºÒ¹ýÆÄ°ßÀÇ ÇüÅÂ¿Í À¯»çÇÏ´Ù ÇÒ °ÍÀÔ´Ï´Ù.



We workers at internal subcontractors will keep on struggling against contractors as well as Government in order to remove discriminations and poor conditions. Think about sorrows of and violence to non-workers behind excellence and growth of Korean Automobiles displayed at Seoul Motor Show.
